Public Offer Agreement
This agreement is an official and public offer of the Seller to conclude a contract for the sale of Goods presented on the online store website. The terms of this agreement are the same for all buyers regardless of their status.
By entering into this Agreement, the Buyer fully accepts the terms of ordering, payment, delivery, return of Goods, as well as other terms of this Agreement.
The Agreement is considered concluded from the moment the “Confirm order” button is clicked and the order confirmation is received from the Seller electronically.
1. Definitions
1.1. Public offer — a public proposal of the Seller addressed to an indefinite circle of persons to conclude a contract for the sale of goods remotely.
1.2. Goods or Services — the subject of the agreement between the parties selected by the Buyer on the online store website.
1.3. Online store — the Seller’s website intended for concluding retail and wholesale sales contracts via the Internet.
1.4. Buyer — a legally capable individual over 18 years old, or a legal entity or individual entrepreneur.
1.5. Seller — a person selling goods through the online store.
2. Subject of the Agreement
2.1. The Seller undertakes to transfer the Goods into the ownership of the Buyer, and the Buyer undertakes to pay for and accept the Goods under the terms of this Agreement.
2.2. The date of conclusion of the Agreement is the date the Buyer places the order and receives confirmation from the Seller.
3. Placing an order
3.1. The Buyer independently places an order via the website, by email, or by phone указанному in the “Contacts” section.
3.2. The Seller has the right to refuse to fulfill the order if incomplete or inaccurate information is provided.
3.3. When placing an order, the Buyer must provide:
- first and last name;
- delivery address (if required);
- contact phone number;
- registration details (for legal entities and entrepreneurs).
3.4. The Buyer is responsible for the accuracy of the provided data.
3.5. By placing an order, the Buyer confirms acceptance of this Offer and consents to the processing of personal data.
4. Price and delivery of goods
4.1. Prices for Goods are set by the Seller and indicated on the online store website.
4.2. The Seller has the right to change prices unilaterally, except for already paid orders.
4.3. Delivery cost is not included in the price of the Goods and is paid separately by the Buyer.
4.4. Payment obligations are considered fulfilled upon receipt of funds by the Seller.
4.5. Upon receipt of the Goods, the Buyer must check quantity, completeness, and appearance.
5. Rights and obligations of the parties
5.1. The Seller undertakes to deliver the Goods in accordance with this Agreement.
5.2. The Seller has the right to amend the Agreement by publishing changes on the website.
5.3. The Buyer undertakes to provide accurate information necessary to fulfill the order.
6. Return of goods
6.1. The Buyer has the right to return Goods of proper quality within 14 calendar days from receipt.
6.2. Refunds are made within 30 calendar days from the date the Seller receives the Goods.
6.3. Return shipping is at the Buyer’s expense.
6.4. Goods made to individual order are not subject to return.
7. Liability
7.1. The Seller is not liable for damage caused by improper use of the Goods.
7.2. The parties are released from liability in the event of force majeure circumstances.
8. Confidentiality
8.1. The Buyer consents to the processing of personal data without time limitation.
8.2. The Seller undertakes not to disclose personal data except where necessary to fulfill the order.
9. Other conditions
9.1. All disputes are resolved through negotiations, and if no agreement is reached — in court in accordance with applicable law.
9.2. The Seller has the right to amend this Agreement unilaterally.
